Artikel 96: Declaration of war

Artikel 96
  1. A declaration that the Kingdom is in a state of war shall not be made without the prior approval of the States General.
  2. Such approval shall not be required in cases where consultation with Parliament proves to be impossible as a consequence of the actual existence of a state of war.
  3. The two Houses of the States General shall consider and decide upon the matter in joint session.
  4. The provisions of the first and third paragraphs shall apply mutatis mutandis to a declaration that a state of war has ceased.

  1. Nur nach vorheriger Zustimmung der Generalstaaten kann erklärt werden, dass sich das Königreich im Krieg befindet.
  2. Die Zustimmung ist nicht erforderlich, wenn sich infolge eines faktisch bereits bestehenden Kriegszustands Beratungen mit den Generalstaaten als nicht möglich erwiesen haben.
  3. Die Generalstaaten beraten und beschließen hierüber in einer Vollversammlung.
  4. Die Bestimmungen in Absatz 1 und 3 gelten entsprechend für eine Erklärung zur Beendigung eines Krieges.

  1. El Reino no podrá ser declarado en estado de guerra sin la autorización previa de los Estados Generales.
  2. No se requerirá esta autorización cuando, por existir de hecho un estado de guerra, la previa consulta de los Estados Generales hubiere resultado imposible.
  3. Los Estados Generales deliberarán y decidirán en esa materia reunidos en sesión conjunta.
  4. Lo dispuesto en los apartados primero y tercero se aplicará por analogía a una declaración de una guerra terminación de lunna guerra.

The government may not declare war on the Kingdom without the prior consent of the States General. Proceedings in a joint session are prescribed to prevent one House from voting in favor of the declaration of war while the other does not.

This concerns a declaration of war because a war of aggression is prohibited under international law. According to the Charter of the United Nations, a state may only use armed force in cases of individual or collective self-defense.

The consent of the States General is not required when consultation with the States General is not possible due to a war already underway. The requirement of prior consent from the joint session also applies to the declaration that a war has ended.
