Article 11: Bodily integrity
Everyone shall have the right to inviolability of his person, without prejudice to restrictions laid down by or pursuant to Act of Parliament.
Explanation
Please note: Only the Dutch-language version of the Constitution has legal effect.
This article establishes the right to bodily integrity. Everyone may decide what happens to their body, which medical procedures they undergo and which medicines they take.
Restrictions on bodily integrity must have a basis in an Act of Parliament or in rules made under such an Act.
Protecting public health more broadly can also be a legitimate aim, because a measure may help increase the overall vaccination rate. The legislature has considerable discretion when choosing and designing measures to protect public health.
