Artikel 118: Supreme Court; cassation

Artikel 118
  1. The members of the Supreme Court of the Netherlands shall be appointed from a list of three persons drawn up by the Lower House of the States General.
  2. In the cases and within the limits laid down by Act of Parliament, the Supreme Court shall be responsible for annulling court judgments which infringe the law (cassation).
  3. Additional duties may be assigned to the Supreme Court by Act of Parliament.

  1. Die Mitglieder des Hohen Rates der Niederlande werden auf Vorschlag der Zweiten Kammer der Generalstaaten ernannt, die jeweils drei Kandidaten vorschlägt.
  2. Dem Hohen Rat obliegt in den durch Gesetz bezeichneten Fällen und innerhalb der gesetzlichen Grenzen die Kassation richterlicher Entscheidungen wegen Verletzung des Rechts.
  3. Durch Gesetz können dem Hohen Rat auch andere Aufgaben übertragen werden.

The members of the Supreme Court are appointed by Royal Decree, after the House of Representatives has nominated three persons.

The main task of the Supreme Court is to review judicial decisions. This is called 'cassation'. The Supreme Court then examines whether the ruling must be overturned due to a violation of the law.

The Supreme Court may also be assigned other tasks by law.
