  1. The Kingdom shall not be bound by treaties, nor shall such treaties be denounced without the prior approval of the States General. The cases in which approval is not required shall be specified by Act of Parliament.
  2. The manner in which approval shall be granted shall be laid down by Act of Parliament, which may provide for the possibility of tacit approval.
  3. Any provisions of a treaty that conflict with the Constitution or which lead to conflicts with it may be approved by the Houses of the States General only if at least two-thirds of the votes cast are in favour.

  1. Ohne vorherige Zustimmung durch die Generalstaaten ist das Königreich nicht an Verträge gebunden und werden Verträge nicht gekündigt. Die Fälle, in denen keine Zustimmung erforderlich ist, bezeichnet das Gesetz.
  2. Durch Gesetz wird bestimmt, in welcher Weise die Zustimmung erteilt wird. Das Gesetz kann eine stillschweigende Zustimmung vorsehen.
  3. Enthält ein Vertrag Bestimmungen, die von der Verfassung abweichen beziehungsweise eine solche Abweichung erforderlich machen, können die Kammern ihre Zustimmung nur mit einer Mehrheit von mindestens zwei Dritteln der abgegebenen Stimmen erteilen.

  1. El Reino no quedará vinculado por tratados y éstos no podrán ser denunciados sin la aprobación previa de los Estados Generales. La ley determinará los casos en que no se requiera tal aprobación.
  2. La ley regulará el procedimiento de la prestación de aprobación, pudiendo también prever la aprobación tácita.
  3. Cuando un tratado contuviere estipulaciones que deroguen la Constitución o que impongan la necesidad de tal derogación, se requerirá para su adopción por las Cámaras una mayoría de al menos dos tercios del número de votos emitidos.

As a general rule, the Kingdom cannot be bound by treaties without the prior approval of the States General. The Kingdom Act on the Approval and Publication of Treaties regulates:

  • when tacit approval applies
  • when approval is granted by means of a law
  • when no approval is required.

It is possible for a treaty to deviate from provisions of the Constitution. In such a case, approval by the Houses of the States General is required with at least two-thirds of the votes cast.
