Artikel 129: Election of members of provincial and municipal councils; term of office; incompatibilities; voting without mandate
- The members of provincial and municipal councils shall be directly elected by Dutch nationals resident in the province or municipality as the case may be who satisfy the requirements laid down for elections to the Lower House of the States General. The same conditions apply to membership.
- The members shall be elected by proportional representation within the boundaries to be laid down by Act of Parliament.

- Die Mitglieder der Provinzialstaaten und des Gemeinderats werden unmittelbar von den in der Provinz beziehungsweise in der Gemeinde ansässigen Niederländern gewählt, die die für die Wahl der Zweiten Kammer der Generalstaaten geltenden Voraussetzungen erfüllen. Für die Mitgliedschaft in einem der beiden Gremien gelten dieselben Voraussetzungen.
- Die Mitglieder werden auf der Grundlage des Verhältniswahlrechts innerhalb der durch Gesetz festzulegenden Grenzen gewählt.
- Artikel 53 Absatz 2 und Artikel 59 sind anzuwenden.

- Los miembros de los Estados Provinciales y del Concejo Municipal serán elegidos directamente por los holandeses que residan en la respectiva provincia o el respectivo municipio y que reúnan los requisitos de aplicación a la elección de la Segunda Cámara de los Estados Generales. Los mismos requisitos serán de aplicación a la elegibilidad de los miembros.
- Los miembros son elegidos sobre la base de la representación proporcional dentro de los límites que la ley establezca.
- Los artículos 53, apartado segundo, y 59 serán de aplicación. Artículo 57a será de aplicación por analogía.

The requirements for active and passive voting rights for the Provincial Council and the municipal council are the same as those for the House of Representatives. However, an additional condition applies: the eligible voter must reside in the relevant province or municipality.
The Provincial Council and the municipal council are elected every four years on the basis of proportional representation. Temporary replacement due to pregnancy is possible.
The (Electoral) Act sets out the conditions for membership of the Provincial Council and the municipal council. For instance, the Act stipulates that marriage or kinship may be grounds for the loss of membership.
