Artikel 130: suffrage for foreigners
The right to elect members of a municipal council and the right to be a member of a municipal council may be granted by Act of Parliament to residents who are not Dutch nationals provided they fulfil at least the requirements applicable to residents who are Dutch nationals.

Please note: Only the Dutch-language version of the Constitution has legal effect.
A law may stipulate that residents who are not Dutch nationals have active and passive voting rights for the municipal council. This applies only to those who meet the requirements for Dutch residents.
As an implementation of this, the Electoral Act was amended in 1985. The active and passive voting rights in municipal council elections for citizens of the European Union are also based on the Treaty on the Functioning of the European Union.
