Artikel 100: Maintenance or promotion of the international legal order

Artikel 100
  1. The Government shall inform the States General in advance if the armed forces are to be deployed or made available to maintain or promote the international legal order. This shall include the provision of humanitarian aid in the event of armed conflict.
  2. The provisions of paragraph 1 shall not apply if compelling reasons exist to prevent the provision of information in advance. In this event, information shall be supplied as soon as possible.

Hierzu zählt das Erteilen von Auskünften im Voraus über den Einsatz oder die Bereitstellung der Streitkräfte für humanitäre Hilfsleistungen im Falle eines bewaffneten Konflikts.
  2. Absatz 1 findet keine Anwendung, wenn zwingende Gründe der Erteilung von Auskünften im Voraus entgegenstehen. In diesem Fall werden Auskünfte schnellstmöglich erteilt.

  1. El Gobierno informará previamente a los Estados Generales sobre la utilización o la puesta a disposición de las Fuerzas Armadas para mantener o fomentar el orden jurídico internacional. Dentro de lo anterior se incluirá también la información previa sobre la utilización o la puesta a disposición de las Fuerzas Armadas para la prestación de ayuda humanitaria en caso de conflicto armado.
  2. No se aplicará lo dispuesto en el primer párrafo si existen motivos urgentes que impidan que se facilite información previamente. En ese caso, deberá facilitarse información al respecto lo antes posible.

The government must inform the States General in advance if it intends to deploy the armed forces to maintain or promote the international legal order, and for the purpose of providing assistance in the event of an armed conflict. Therefore, if the government wishes to deploy troops to a 'crisis area' within the NATO framework, it must notify the House of Representatives and the Senate. Unlike Article 96 (the declaration of war), Article 100 does not contain the requirement of formal consent from the States General.

If compelling reasons prevent prior notification, the government must provide the information as soon as possible.
