The European Commission has decided, under Article 228 of the EC Treaty, to send a letter of formal notice to Ireland requesting full information on its compliance with a 2008 judgement of the European Court of Justice (Case C 211/07) concerning payment of compensation to those without motor insurance.
This judgement concerned the rules contained in sections 5.2 and 5.3 of the Motor Insurance Agreement of 31 March 2004 between the Minister for Transport and the Motor Insurers’ Bureau of Ireland, under which there is to be no payment of compensation from the Bureau to passengers of vehicles where all vehicles involved in a collision are uninsured, regardless of the circumstances.
To date, Ireland has not complied with the judgement.
A letter of formal notice is the first stage of the Commission’s infringement procedures enshrined in Article 228(2) of the EC Treaty, under which financial penalties may be imposed by the European Court of Justice on a Member State that fails to comply with its judgment. After having considered the Irish reply, which is to be submitted within two months from receipt of the letter, the Commission may, if appropriate, issue a reasoned opinion.
