Raadsbesluiten over voorbereiding SIS gebruikers op overstap naar SIS II (en)

The Council adopted the following conclusions: "THE COUNCIL OF THE EUROPEAN UNION,

CONFIRMS that the implementation of the second-generation Schengen Information System (SIS II) remains an absolute priority, and demands joint action and close cooperation between the Member States and the Commission;

RECALLS its conclusions of 5 June 20091, 6 May 20102 and 6 June 20103 on SIS II and REAFFIRMS THEIR CONTT;

RECALLS the mandate concerning the need to develop SIS II adopted by the Council on

6 December 20014, as amended on 24 October 20085 and then amended and extended on

3 June 20106, setting out the competences and tasks of the Commission and the Member States in

relation to the development and final establishment of SIS U's central system and communications

infrastructure;

CALLS ON all the parties concerned to make every effort to ensure that the project can be fully realised in accordance with the proposed schedule and financial plan;

Considering the SIS II implementation schedule, and in particular the data loading phase of migration from SIS 1+ to SIS II and the connected process of correction and adaptation of SIS 1+ alerts to the requirements laid down for SIS II alerts7, which is essential for the migration of alerts, CALLS ON AND COURAGES Member States to step up measures aiming to prepare national SIS users for improvements to the quality of SIS 1+ data prior to their migration to SIS II;

Whereas SIS 1+ is currently used intensively in the everyday work of the individual Member States' national SIS users, resulting in a steady increase in the number of alerts, COURAGES Member States to regularly monitor the quality of SIS 1+ data with regard to both the future migration to SIS II and the general quality of the data processed in the system, with the aim of increasing the reliability and credibility of the data contained therein;

Considering the importance of the aforementioned process of improving the quality of SIS 1+ alerts for the successful migration of data to SIS II, and hence for the potential launch of SIS II, and bearing in mind the complexity of both processes, with a view to helping Member States to both prepare for and successfully complete those processes, INVITES MEMBER STATES TO:

  • 1. 
    implement, as soon as possible, the corrective and preventive mechanisms (for current SIS 1+ alerts and new SIS 1+ alerts respectively), so that they can be adapted to the data quality requirements laid down for SIS II alerts;
  • 2. 
    prior to the launch of the migration of SIS 1+ data to SIS II, once again review the conformity of current alerts with SIS II dictionaries, ensuring that they comply with the final version of those dictionaries;
  • 3. 
    via the competent national authorities responsible for the quality of SIS data, systematically monitor the accuracy of the alerts entered in the national system of SIS 1+, this being essential for ensuring the trouble-free use of the mapping/dictionary mapping mechanism (compliance of national dictionaries with SIS II dictionaries)

Furthermore, COURAGES Member States to promote cooperation between national SIS users and the authorities responsible for the quality of SIS data in the Member States in order to raise awareness of any inaccuracies in the alerts, e.g. by introducing appropriate national provisions in order to facilitate the SIS users to inform without delay the competent authority of any errors in the alerts, in order to increase the effectiveness of measures to ensure the quality of the SIS 1+ data;

ALSO CALLS ON the competent national authorities responsible for the quality of SIS data to engage in broader cooperation with national SIS users, drawing their attention to the problem of incompatibility between SIS 1+ and SIS II alerts, and in particular differences in the status of fields in the alerts (optional or non-existent in SIS 1+ and compulsory in SIS II)8;

COURAGES Member States to introduce mechanisms and tools to help ensure the effective execution of the process to improve the quality of SIS 1+ data, in accordance with the guidelines laid down in /11 REV 1 SIRIS 69 COMIX 440 ("Analysis of Member States' replies") and /11 REV 1 SIRIS 70 COMIX 442 ("Information on "cleansing" of the SIS 1 + prior to data migration")

Moreover, APPRECIATING THE EFFORTS MADE BY AND INVOLVEMT OF C.SIS in the SIS II implementation process, as well as with regard to the preparation of tools to help Member States improve the quality of the SIS 1+ data, ASKS C.SIS TO CONSIDER the possibility of:

    generating, through C-SIS, a general report on the migration in respect of all the Member States based on the "data quality report", inter alia containing data on the number of "warnings" in specific controlled areas, subdivided into the category of alert, the percentage share of the "warnings" in the total number of alerts covered by the migration to SIS II and information about the number of alerts with "warnings" (subdivided in turn into alerts requiring correction prior to the migration (denoted by the symbol "M") and alerts covered by the 3-year amnesty period (denoted by the symbol "O")). Such a list should contain information concerning both the number of "warnings" in respect of alerts in the Member States as a whole (i.e. the total number) and the number of "warnings" in individual Member States. Such a solution will provide Member States with an additional tool to help them monitor the quality of their own alerts and the accuracy of their interpretation of the reports/ DMC files, and will also illustrate the magnitude of the problem
  • • 
    creating a separate report for alerts subject to monitoring under Chapter 16 of SIS-TECH 47 COMIX 271 ("Alerts which have expired - status of logical deletion"), which will help Member States identify the actual number of alerts accompanied by "warnings", while at the same time eliminating the aforementioned alerts from the C-SIS migration reports/ DMC files

    arranging for the "data quality reports" to be verified by the Member States on a regular basis, and informing C-SIS about the "unfoundedness" of a "flag" within the time limits set previously by the parties concerned."
