The waste hierarchy is, in general, the best environmental option for legislation and policy concerning waste prevention and management. This should therefore be stated clearly and not just as a guideline or indication. With a view to achieving a settlement, this proposal for a Directive has been approved at first reading. We await with interest the future discussions with the European Parliament.""

Its definition as recovery within this Directive will undermine efforts to promote a recycling society and the promotion of reduction and reuse within the waste hierarchy." 5. STATEME T BY FRA CE "France reaffirms its strong attachment to the "polluter pays" principle and, in particular, to the original producer's or holder's responsibility until final treatment of the waste has been carried out. Experience has often - and recently - shown that diluting responsibilities in the treatment chain can undermine the sense of responsibility and thus cause problems and that, in cases where treatment is inadequate, it can give rise to unacceptable health and environmental situations. This can also have the end result that the burden of eliminating badly-treated waste is passed on to the public body concerned. Involving the waste producer through to the final treatment stage is beneficial since it creates an incentive for the producer to seek and choose high-quality and safe forms of treatment. This principle also helps to prevent the development of illicit waste trafficking. Against this background, France reiterates that it will continue to apply this principle of the producer's responsibility in its legislation and will not make use of the option, afforded to Member States under Article 9, of specifying how this responsibility is to be divided among actors in the treatment chain.
